Family Law
What is Family Law?
Australian family law provides the legal framework for families who are experiencing separation or relationship breakdown. While it is principally governed by the Family Law Act 1975, it also encompasses other legislation that supports families as they work through changes to their relationships and future arrangements.
Family law commonly involves decisions about parenting arrangements, parental responsibility, financial and property matters and child support. These issues can often feel overwhelming, particularly during what is already an emotionally difficult time.
For many families, the focus is on finding practical, child focused solutions without the need for lengthy and costly court proceedings. Wherever it is safe and appropriate to do so, Australian family law encourages parents to resolve issues through discussion, family dispute resolution, and other alternative dispute resolution processes before asking a court to make decisions.
The goal is to assist families to reach thoughtful, workable agreements that support the best interests of their children, reduce conflict where possible, and provide a stronger foundation for moving forward.

Parenting Plan
The breakdown of a family is one of life's most difficult transitions, not only for parents, but also for their children. During this time, children benefit from feeling secure, supported and reassured that both parents remain focused on their wellbeing. A carefully considered Parenting Plan can provide greater clarity, consistency and stability, helping children adjust to changing family circumstances while reducing uncertainty for everyone involved.
A Parenting Plan can be developed together during joint sessions or, where appropriate, through separate appointments. Every family is different, so each plan is tailored to your individual circumstances. Together, we can explore the practical arrangements that best support your children, including living arrangements, time with each parent, communication, special occasions, schooling, holidays and other matters that are important to your family. Parenting Plans can also include agreed review periods so that arrangements can continue to reflect your children's changing needs as they grow and develop.
When preparing a Parenting Plan, the primary focus is always the best interests of the children. Where appropriate, their views and experiences may also be considered, taking into account their age, maturity and individual circumstances. The Family Law Act places emphasis on parents meeting their responsibilities towards their children and supporting children to have the benefit of meaningful relationships with both parents, where it is safe to do so, while ensuring they are protected from harm.
Where parents are unable to reach agreement, it may become necessary for the Federal Circuit and Family Court of Australia to determine parenting arrangements through Parenting Orders. While court proceedings are sometimes necessary, many families are able to reach practical and lasting agreements through respectful discussion and family dispute resolution, avoiding the emotional, financial and time demands that litigation can often involve.
Where there are concerns regarding family violence, significant safety issues, or an Apprehended Violence Order that is in place or pending, the suitability of a Parenting Plan will need to be carefully considered on a case by case basis.
A Parenting Plan does not need to be prepared by a solicitor. I can work with you to develop a practical, child focused Parenting Plan that reflects your family's circumstances and provides a clear framework for the future and supports a more co-operative co-parenting relationship.
Parenting & Family Breakdown
Separation changes many aspects of family life, but it does not change what children need most. They continue to need the love, guidance, reassurance and consistent involvement of both parents, wherever it is safe and appropriate.
Children do not expect perfect parents. They benefit most from parents who are emotionally available, genuinely interested in their lives, and able to place their children's needs ahead of the conflict between the adults. Although this can be difficult during separation, it is one of the greatest gifts parents can give their children.
Maintaining a meaningful relationship does not depend solely on the amount of time you spend together. It is built through regular contact, shared experiences, reliability, listening without judgement, showing interest in your child's everyday life, and creating moments where they feel safe, valued and connected.
Children also benefit when both homes feel familiar and welcoming. Simple routines, predictable arrangements and allowing children time to settle into each home can provide a sense of security during what is often an uncertain period.
Where possible, parents should avoid placing children in the middle of adult conflict. Children should never feel responsible for carrying messages, choosing between parents or managing adult concerns. They deserve the freedom to enjoy a positive relationship with each parent without feeling caught in the middle.
Every family is different, and there is no single approach that suits everyone. The suggestions above are intended to encourage parents to remain focused on what matters most, maintaining a secure, loving and dependable relationship with their children as they adjust to their family's changing circumstances.
“Children rarely remember every activity they did with a parent. They remember how they felt when they were with them. Feeling listened to, accepted, loved and emotionally safe creates lasting memories and strengthens the parent child relationship long after separation has passed.”
— Josephine Byrnes-Luna
Working together to Reach Agreement
Family separation is rarely easy. Emotions can be heightened, communication can become difficult, and decisions about children and the future often feel overwhelming. Even so, many families are able to reach practical and lasting agreements when they are supported through a calm, structured and respectful process.
My role is to help create an environment where each person has the opportunity to be heard, concerns can be explored openly, and discussions remain focused on finding workable solutions rather than becoming caught up in ongoing conflict.
Where appropriate, I work with parents and families to identify common goals, improve communication, clarify misunderstandings and develop practical agreements that reflect their individual circumstances. Every family is different, and there is no single solution that suits everyone.
Reaching agreement together allows parents to remain actively involved in making decisions about their own family. Rather than having outcomes imposed by others, families often find that agreements they have developed themselves are more practical, more sustainable and better able to adapt as circumstances change.
When families are able to communicate respectfully and remain focused on the needs of their children, they are often surprised by how much can be achieved outside of a courtroom. Even where agreement cannot be reached on every issue, narrowing the areas of disagreement can significantly reduce emotional, financial and practical pressures.
Throughout this process, my focus remains on helping families move towards practical outcomes that support the wellbeing of their children, encourage respectful communication and provide a stronger foundation for the future.
Depending on your family's circumstances, this may involve Family Dispute Resolution, Parenting Co-ordination, Family Therapy, Child Inclusive Practice or assistance in developing a Parenting Plan. Together, we can determine the most appropriate pathway for your family's individual needs.
